Scope and acceptance
These Terms and Conditions apply to the public HAVIKWAY website and the features made available through it, including journal content, expedition pages, live tracking, user accounts, newsletter forms, supporter tools and sponsor pages.
By using the website, you agree to use it in accordance with these terms and with applicable law. If you do not agree with these terms, you should stop using the website.
Permitted use of the website
You may use HAVIKWAY for normal personal, informational and community purposes. You must not use the website in a way that harms the platform, other visitors or third parties.
You must not:
- attempt to gain unauthorized access to accounts, administration areas, databases or servers;
- interfere with security, authentication, rate limits, availability or technical operation;
- submit malicious code, automated abuse, spam or fraudulent information;
- impersonate another person or falsely claim an association with HAVIKWAY;
- scrape, reproduce or redistribute substantial parts of the website in a way that infringes rights or disrupts the service;
- use expedition location information to harass, stalk, threaten or endanger any person.
Accounts and access
Some HAVIKWAY features may require an account. When creating or using an account, you are responsible for providing accurate information and for protecting your login credentials.
You are responsible for activity performed through your account unless you report unauthorized access without unreasonable delay.
HAVIKWAY may restrict, suspend or close access where there is a reasonable basis to believe that an account is being used fraudulently, unlawfully, abusively or in a way that threatens the security of the platform.
Journal, route and expedition content
HAVIKWAY publishes expedition notes, photographs, route information, observations, articles and other editorial material. This content reflects information available at the time of publication and may later become incomplete or outdated.
Route conditions, visa requirements, border rules, transport services, weather, prices, safety conditions and local regulations can change quickly. Readers remain responsible for independently verifying information before relying on it for travel, financial or safety decisions.
It should not be treated as legal, immigration, medical, financial or professional safety advice.
Live tracking and location data
HAVIKWAY may display public route points, current-location information, daily progress or historical tracking data.
Public tracking may be delayed, rounded, filtered, hidden or unavailable for privacy, operational or safety reasons. A displayed point does not guarantee that the traveller is still physically present at that location.
Absence of a public location does not necessarily mean that no movement has occurred, and users should never rely on public tracking as an emergency-response service.
HAVIKWAY may intentionally reduce the accuracy, timing or availability of public location information.
Donations and financial support
Where HAVIKWAY offers donation or support functionality, payments are voluntary unless a specific paid service is clearly identified before payment.
A donation does not create ownership rights, editorial control, decision-making authority or a right to direct the route or activities of the expedition.
Payment processing may be performed by external payment providers. Their own terms, privacy notices and payment rules may apply to the transaction.
If a payment is made in error, you may contact HAVIKWAY. Any refund request will be assessed based on the circumstances, the payment provider's capabilities and applicable consumer or payment rules.
Membership and supporter access
HAVIKWAY may offer supporter or membership features that provide access to additional content, expedition updates, tracking views or community features.
The exact benefits, price and billing structure must be shown before a paid membership is activated. Features may evolve as the expedition changes, provided that material changes are communicated appropriately.
Membership does not guarantee continuous live tracking, uninterrupted communication, a specific expedition route or access to information that HAVIKWAY reasonably withholds for safety or privacy.
Sponsors and commercial relationships
HAVIKWAY may identify sponsors, partners or organizations that provide financial, material or logistical support.
A sponsor relationship does not automatically mean that HAVIKWAY endorses every product, service, statement or activity of that sponsor.
Where content is materially influenced by a paid commercial relationship, HAVIKWAY should identify that relationship in a reasonably clear manner.
Intellectual property
Unless otherwise stated, HAVIKWAY website text, original photography, graphics, branding, route presentation, logos and editorial material are protected by applicable intellectual-property rights.
You may link to public HAVIKWAY pages and may quote limited portions for legitimate commentary, reporting or reference where permitted by law and where appropriate attribution is provided.
You may not reproduce, sell, republish, mirror or commercially exploit substantial parts of HAVIKWAY content without permission, except where applicable law independently permits it.
Availability and limitation of liability
HAVIKWAY aims to keep the website accurate, useful and available, but does not guarantee continuous availability, error-free operation or uninterrupted access to any feature.
Features may be temporarily unavailable because of maintenance, network failure, satellite coverage, third-party services, hosting incidents, security measures or conditions encountered during the expedition.
To the maximum extent permitted by applicable law, HAVIKWAY is not responsible for indirect losses arising solely from reliance on outdated, delayed or incomplete public information.
Nothing in these terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
Changes to the website and these terms
HAVIKWAY may change, add or remove website features as the expedition and platform develop.
These terms may also be updated when the platform, legal requirements, payment methods, support services or operational practices change.
The version and update date shown on this page indicate the current published terms.
